L.L.C S.O.C owner and operator of Ebsher ("Ebsher", "we", "us", "our") and any future company license that holds the rights to this platform and mobile Apps.
By using the Ebsher Application, you also agree to be bound by the Apple Standard End User License Agreement (EULA) where applicable, which supplements these Terms.
These Terms apply to all users of the Site and Application, including but not limited to browsers, vendors, customers, providers, and/or content contributors ("Users"). You understand and agree that Ebsher or its affiliates may limit or terminate your access to the Services at any time if you do not comply with these Terms or at our sole discretion.
By accessing or using any part of the Site or Application, you confirm that you have read, understood, and agreed to be bound by these Terms, along with any additional guidelines, policies, or rules applicable to the Site and Application, including without limitation the Ebsher Privacy Policy, which is incorporated herein by reference.
IF YOU DO NOT AGREE TO THESE TERMS OR TO ABIDE BY ALL APPLICABLE LAWS, GUIDELINES, AND POLICIES, DO NOT USE THE SITE OR APPLICATION.
Our Services may include text, data, graphics, images, or other forms of content (collectively, "Content") created by us or by third parties, including healthcare providers and partners such as doctors, clinics, laboratories, imaging centers, and pharmacies.
Ebsher offers a website and a mobile application that allow users to book healthcare services, including physical consultations with clinics, hospitals, and diagnostic centers, as well as virtual consultations with licensed providers. These services are collectively referred to as the “Services.” While we currently focus on providing healthcare services in Iraq, online consultations may be conducted with licensed doctors from various countries and may be accessed from anywhere.
The platform may operate under various names, including related Ebsher brands or affiliated service providers. Some healthcare providers may be independent third parties and not directly affiliated with Ebsher.
Some parts of our Services are accessible without registration or a password. These are referred to as “Public Services.” You may use these on a personal, non-commercial basis, provided you comply with these Terms. Public Services may include directories listing healthcare providers (referred to as “Providers”) such as doctors, labs, or imaging centers. These directories are provided solely for convenience and only include providers who use Ebsher and choose to be listed.
A listing does not represent an endorsement or certification by Ebsher. The accuracy of provider data (including qualifications, availability, or pricing) is based on self-submitted information, and while we strive to maintain accuracy, we do not guarantee or warrant the correctness of any such details. We are not liable for actions you take based on this content, nor do we guarantee appointment availability.
Certain Services are protected by security measures and require user authentication via credentials (e.g., usernames and passwords). These are known as “Protected Services.” To access them, you must provide accurate personal information. If you are registering or using these services on behalf of another person (e.g., a family member), you must also provide their relevant information.
Protected Services include access to your private Medical Record — such as lab results, consultation summaries, and other health data — securely stored in your Ebsher account. You remain the sole owner of this data. By agreeing to use the Services, you allow authorized providers to send information directly to your private account. You may also consent to allow providers to retain your data under your name for continuity of care. If you do not wish to have a Medical Record stored or shared, you may request its removal by contacting us directly, and we will comply.
Our Services may include reviews, ratings, and feedback from users who have interacted with healthcare providers. This content may reflect personal opinions and not those of Ebsher.
These Evaluations are subjective and should not be taken as medical evidence or as professional judgment.
You acknowledge that such user-generated content may contain biases or errors. Ebsher does not pre-screen or verify these submissions and assumes no responsibility for them. We strongly encourage users to independently verify any content found on the platform, including provider qualifications, through official channels such as licensing authorities or medical boards.
All content on the platform is for informational and scheduling purposes only and does not constitute medical advice. Always seek the guidance of a qualified healthcare professional before making any medical decisions.
At Ebsher, we take the privacy and confidentiality of your health information seriously. We are legally required to protect your personal and health-related data and will promptly notify you in the event of a breach that may compromise your information. Your medical data belongs to you, and you control how and when it is shared through our platform.
We will never use or share your information beyond what is outlined in this policy or our Privacy Policy.

In cash at the provider’s location at the time of service
Online through the Ebsher website or mobile app
We may collect payment on behalf of healthcare providers. By using our Services, you agree to the terms set by each Provider. Accepted payment methods may include credit/debit cards, mobile wallets, or local payment gateways where applicable.
We reserve the right to change or update pricing at our discretion. Discounts and promotions may be available and are subject to their specific terms.
All payments are non-refundable unless explicitly stated otherwise by Ebsher.
Refunds (if applicable) will be processed using the original payment method.
In certain cases, we may refund your payment as account credit, to be used toward other Ebsher services.
Refunds are not issued for dissatisfaction with medical outcomes or experiences.
You are entitled to a full refund if:
You cancel your appointment before the scheduled time
The Provider cancels or does not show up
You agree to comply with these Terms, the policies listed on the Site or App, and any local or international laws applicable to your use of Ebsher.
You are granted a limited, revocable, non-exclusive license to access and use the Site, Services, and Content solely for their intended purpose.
All intellectual property remains the sole property of Ebsher or its licensors. You may not copy, redistribute, display, modify, or otherwise use content from our Services without express permission.
While you may browse the Site without registering, certain features require a Ebsher user account ("User Account"). To register, you must provide complete and accurate information and update it if anything changes.
You must be at least 18 years old to create an account. Use by minors is not permitted unless supervised by a legal guardian.
You are responsible for safeguarding your password and any activity under your account. Notify us immediately if you suspect unauthorized access.
You must not:
Share or transfer your account to others
Respond to password requests claiming to be from Ebsher
Attempt to access your account after multiple failed login attempts (2 consecutive failures will temporarily lock access)
By registering, you consent to receive emails related to service updates, changes, and legal notices. You may unsubscribe from marketing messages at any time.
We do our best to provide current and accurate information, but we are not liable for outdated or incomplete content. Always confirm details independently before relying on them.

If you send us submissions (e.g., suggestions, contest entries, or creative ideas), whether at our request or not, you agree that we may use them without restriction. We are under no obligation to (1) keep them confidential, (2) pay compensation, or (3) respond to them.
We may, but are not obligated to, monitor or remove content we deem unlawful, offensive, or in violation of intellectual property rights or these Terms.

Zero Tolerance: Ebsher has a zero-tolerance policy towards objectionable content or abusive users. You are strictly prohibited from posting content that is defamatory, obscene, pornographic, offensive, hateful, or promotes violence/discrimination.
Moderation: We reserve the right to review, monitor, and remove any user-generated content at our sole discretion without prior notice.
Reporting & Blocking: Users have the right to report any content they find objectionable. We also provide a mechanism to block abusive users.
Enforcement: Any user found violating these terms will have their account suspended or permanently terminated within 24 hours of the report being verified.
Occasionally, information on our platform may contain errors or omissions (e.g., pricing, descriptions, availability). We reserve the right to correct such issues and update or cancel any related transactions without notice.
You are prohibited from using the Site, App, or Services for:

Ebsher and its affiliates shall not be liable for any damages, including but not limited to:

Indirect or consequential damages
Claims based on provider behavior, service quality, delays, or cancellations
We assume no responsibility for acts by Providers, including but not limited to:
Unprofessional or unethical behavior
Wrong, delayed, or no diagnosis or treatment
Medical negligence or malpractice
Missed or canceled appointments
IMPORTANT NOTICE: EBSHER IS NOT FOR EMERGENCIES. If you are experiencing a medical emergency, please call your local emergency services immediately. Our platform is a facilitator for scheduling and information; it does not provide medical diagnosis or emergency interventions.
Technology and regulations evolve, and we may update these Terms at any time. Continued use of the Services implies acceptance of updated Terms. The latest version will always be available on this page with the last revision date.
These Terms shall be governed by and interpreted in accordance with the laws of the Republic of Iraq. By using our Services, you agree to submit to the exclusive jurisdiction of the courts of Baghdad, Iraq.
Your account may be suspended or terminated by request or if you violate these Terms.
We may transfer or assign these Terms in the event of a merger, acquisition, or restructuring.
If any provision of these Terms is deemed unenforceable, the remainder will remain in full effect.
Our failure to enforce a right or provision does not constitute a waiver.
These Terms, along with our Privacy Policy and any applicable End User Agreement, represent the full agreement between you and Ebsher regarding the Services and supersede prior understandings.
All healthcare providers, clinics, laboratories, pharmacies, or other entities listed or booked through Ebsher are independent contractors and not employees, agents, or representatives of Ebsher.
Ebsher does not control or supervise the medical judgment, methods, or decisions of these providers and shall not be held responsible for their actions, advice, or conduct.
You acknowledge and agree that any services rendered by these third-party providers are solely between you and the provider, and Ebsher disclaims any and all liability arising therefrom.
Ebsher shall not be liable for any delay or failure to perform its obligations under these Terms due to events beyond its reasonable control. These may include but are not limited to: acts of God, natural disasters, epidemics or pandemics, war, terrorism, riots, labor disputes, internet service interruptions, or governmental actions.
Such circumstances shall suspend Ebsher’s obligations for the duration of the event causing the delay.
These Online Payment Terms constitute a legal agreement between you and Ebsher. By using the online payment functionality available through our website or mobile application, you agree to be bound by these Terms. If you do not agree, do not proceed with payment. To complete a transaction, you must indicate your acceptance by clicking “I Accept.”

By submitting a payment, you confirm that:
You are at least 18 years old
You are authorized to use the selected payment method
All information you provide is accurate and complete
You will be responsible for all charges incurred
You have the legal capacity to enter into this agreement
Payments will be processed in the applicable local currency (e.g., IQD or USD), depending on your location and the service selected
Funds are deducted immediately upon confirmation of the transaction
Due to third-party banking system delays, payment confirmation in our records may take time
All transactions are processed through secure payment gateways (e.g., Amwal, Paytabs, Stripe, or equivalent)
Credit card information is encrypted during transmission using industry-standard SSL encryption
Ebsher does not store or retain your credit card details at any time
Upon successful payment, a confirmation message will appear on-screen, and you may also receive an email or SMS confirmation
If your payment fails, you will be notified immediately. Ebsher does not have access to the reason for the failure. Please contact your card issuer for assistance
In case of payment failure, you are responsible for arranging an alternative payment promptly to avoid disruption of service
Refunds (if applicable) will be processed within a reasonable timeframe. Delays from banks or payment processors may occur and are beyond our control
All refunds will be issued to the original payment method if applicable, unless otherwise agreed, or the support team shall inform you on the method of refund
By using our online payment services, you consent to the secure sharing of your personal data with our payment service provider, exclusively for payment processing purposes. Ebsher upholds high standards of data security and privacy in accordance with our Privacy Policy.
Ebsher reserves the right to amend these payment terms at any time without prior notice. Each transaction is subject to the Terms in effect at the time of payment.
